Part 1 - Basic notions

• For intention of this agreement, the service means accommodation of Internet server functions. hazhir.hu .
• Owner of the website is company Acenso, s.r.o. Acenso s.r.o., ICO: 44 181 744 Address written in register court Presov number 20228/P
• hazhir.hu

Part 2 - Published content

• Whole content of Internet server hazhir.hu (included - but not limited on - articles, photos, images, illustrations, audio or video, web design and scripts) is liable to law n.©. 618/2003 Z. z. autor law with authentic version and other generally definite law formulas and is asset of Operator or his contract partners.
• If not stated otherwise, user can't copy, share or sell the content of this Internet server hazhir.hu.

Part 3 - Rights and commitments of user and operator

• User is fully responsible for content of published Ads, advertisement banners, user profile, blogs and all content entered by user. Operator has not commitment to audit the content if it doesn't deteriorate third persons. For claims of third persons raised against operator is fully responsible user that is committed to bear all claims in full area.
• If published data contains trademarks or logos, user is giving operator automatically right to publish them and use them. User guarantees that is allowed to use those trade marks and logos and operator has not duty to examine it.
• User guarantees that will not publish content that is harmful, deceptive or in defiance of valid law, ethics or generally valid moral principles.
• User guarantees to use uploaded imagery, that is related to published ads or banners and other content and will publish only actual data.
• User guarantees that will publish only data and text related to advertised property. User guarantees that will not publish the same ad two or more times.
• Operator has right not to publish without compensation any content that is not following this agreement rules. Operator has right to remove, delete or disable any content without compensation that is not following this agreement rules. In case of serious or multiple breaking of agreement rules operator is allowed to deny access to server and it's services without compensation hazhir.hu.

Part 4 - Services price, invoicing and cancellation conditions

• Every order purchased by user is paid via Paypal, credit card, debit or other card, bank transfer or other implemented way of purchase.
• User is emailed after payment and will receive invoice in pdf format. This service is activated automatically where possible.
• In case of order cancellation, the service is deactivated and Operator is guarantees to return paid price lowered by transaction charges.

Part 5 - Objection

• Operator guarantees the best service administration as possible.
• User is liable to file a complaint caused by error on side of Operator.
• User is liable to claim for compensation with maximum of paid price or to negotiate adequate compensation.
• Period to apply objection is within 14 days from date when user found a problem or could find it.
• Objection is user allowed to carry out by writing or email. Operator is liable to reply to any objection within 14 days by email from date received.
• Aberrance on side of Operator is service failure related to user order during the time longer then 6 hours between time of 6:00 and 22:00.
• Charge deduction is applied using credit note or compensation negotiated by both sides.

Part 6. Final statements

• Personal Data
  • Operator will not give personal data to third person without owner permission.
  • Operator is under an obligation that will keep silence about personal data and won't give personal data to third person without owner permission ( § 18 part. 2 law n. 428/2002 about security of personal data in information systems)
• Operator Assurances at data availability
  • Operator is responsible for data availability corresponding to usual technical standard. User has to take in mind, that with current level of technology it is not always possible to have 100% data availability. Operator is not responsible for data unavailability in following cases:
  • Of inappropriate use of software or hardware or hardware failure.
  • Communication errors of partner networks or other Internet providers.
  • Server Outage caused by Internet provider or mistake caused by third person.
  • Server Outage that lasts no longer then 5 hours between time of 5:00 and 22:00.
  • Server Outage from time of 22:00 until 5:00 due to configuration or upgrade.
• Other
  • Operator is allowed to modify this agreement. New agreement text will be published until 15 workdays before their validity start on the web, by email or writing.
  • We declare right to change the type and prices of offered services. These changes will be applied only to unordered services.

This agreement is valid from 01.07.2008.
